McCarn waives preliminary hearing

Daniel Victor McCarn, 29 of Scottsboro, formerly of Huntsville, remains in the Jackson County Jail on a $10,015,000 bond after being charged with attempted murder and leaving the scene of an accident in connection with the July 26, 2025 shooting of Scottsboro Police Lt. Derek Porch. Porch, a 29-year veteran of the Scottsboro Police Department, sustained serious but non-life-threatening injuries in the incident. Porch returned home on August 14.

McCarn, represented by Huntsville attorney Robert B. Tuten, waived his preliminary hearing, which had been scheduled for Sept. 3, and will instead have his cases presented to the Jackson County Grand Jury on Sept. 8.

According to police reports, Scottsboro officers responded to a domestic incident on Ruth Street around 12:49 a.m. on July 26. When officers arrived, McCarn allegedly fled in a vehicle, leading police on a pursuit. The chase ended in a crash at the intersection of U.S. Highway 72 and County Park Road. Police say McCarn exited the vehicle and opened fire, striking Lt. Porch. McCarn then fled on foot, prompting a multi-agency manhunt in the County Park and Highway 72 area. He was taken into custody later the same day.
